6. Account Registration and Security

To make travel bookings or access certain features of the Service, you may be required to create an account on the Site. When creating an account, you agree to:

Update your information as necessary to maintain its accuracy.
Maintain the confidentiality of your account credentials.
Notify us immediately of any unauthorized use of your account.

You are responsible for all activities that occur under your account, including any bookings, payments, or fees incurred. We are not liable for any loss or damage arising from your failure to safeguard your account information.

7. Bookings, Payments, and Fees

When you make a travel booking through the Site, you agree to:

Pay all applicable fees, taxes, and charges for the booking.
Provide accurate and complete payment information, including credit card details.
Authorize us or our third-party payment processors to charge your payment method for all fees associated with the booking.

We reserve the right to change our fees, pricing, and payment methods at any time. All bookings are subject to availability and our Cancellation Policy, which may include non-refundable reservations.

Role of Snowstorm; billing. Snowstorm is the contracting party for the Services and may use subcontractors for fulfillment. Charges for items arranged through the Services may be billed by Snowstorm or, where disclosed at checkout, directly by a supplier or venue. Any supplier-specific rules disclosed at checkout or in your confirmation (for example, park blackout dates, ticket activation windows, return windows, or change/cancel rules) form part of your order for that item.

8. Travel Products and Services

We offer a variety of travel-related products and services, including but not limited to:

Flight bookings
Hotel reservations
Car rentals
Transfers and activities
Travel insurance
Cruises
All-Inclusive

These services are provided through third-party providers. By making a booking, you agree to the terms and conditions of each individual travel provider (e.g., airlines, hotels, car rental agencies), which may vary depending on the provider and destination.

We act solely as an intermediary between you and these providers and are not responsible for the performance or non-performance of the travel services provided by third parties.

9. Concierge Services

Scope. On-demand lifestyle and travel concierge assistance to research, recommend, arrange, and/or book goods or services you request (e.g., restaurants, events, deliveries, travel).
How requests work. You submit requests through channels we make available (web, app, chat, or phone). We may ask for additional details or verification. When you approve an option and payment method, you authorize us to place orders or reservations on your behalf.
Availability & limits. Concierge is not an emergency service. Availability depends on venue/supplier participation, operating hours, and inventory. We use reasonable skill and care but cannot guarantee a specific outcome, availability, or price until confirmed.
Supplier rules. Items arranged through concierge may be subject to supplier or venue rules (for example, age or dress codes, security policies, park rules, or ticket usage rules). These will be disclosed where applicable and apply to your order.
Cancellations/changes. Eligibility for cancellation, change, or refund follows the rules disclosed at the time of confirmation for the specific item (for example, non-refundable event tickets). Any Snowstorm service fees, if charged, are not refundable unless we state otherwise.
Acceptable use. You agree not to use concierge to obtain prohibited or illegal items, harass others, bypass supplier limits, or facilitate unauthorized resale/scalping.
Data use. We share only what is reasonably necessary with subcontractors and suppliers to fulfill your request and provide support.

10. Theme Parks & Movies

Scope. Discounted access to theme parks, attractions, experiences, and cinema tickets for Insider Pass members.
Ticket rules. Unless stated otherwise, tickets are non-transferable, not for resale, void if altered or duplicated, and may require ID that matches the purchaser/attendee. Tickets can include activation windows, expiration dates, blackout dates, and/or advance reservation requirements for park entry. The specific terms for a ticket are displayed at checkout and included in your confirmation and form part of your order.
Pricing & availability. Prices, inventory, and participating venues can change without notice. If a supplier or venue cannot honor an item after purchase due to error or unavailability, we may cancel and refund that item or offer a reasonable alternative.
Cancellations & refunds. Eligibility follows the ticket policy disclosed at checkout and in your confirmation. Many attraction and movie tickets are non-refundable once issued.
Regulatory notices; issuing entity. Certain tickets or travel-adjacent items may require disclosures (for example, Seller-of-Travel statements) or issuance by a registered entity. Where applicable, such disclosures and the name of the issuing entity will be presented at checkout and/or in your confirmation and form part of your order.
Conduct & compliance. You must comply with venue rules, safety guidance, and applicable law (for example, no recording in theaters; no line-skipping except where permitted by the venue).
Fraud & abuse. We may cancel, void, or refuse fulfillment of any ticket or booking if we reasonably suspect fraud, misuse, resale in violation of these Terms, or error. If a charge was captured, we will refund the affected item unless prohibited by venue/supplier rules disclosed at purchase.
Rewards/credits. If a rewards, wallet, or credit feature is offered for these items, accrual, redemption, and expiration rules will be disclosed in your account and/or at checkout and may vary by offer.
Data use. We share only what is reasonably necessary with subcontractors and venues to issue tickets, validate entry, and manage support.

11. Merchandise

Scope. Member-only merchandise and goods.
Orders & fulfillment. Orders are subject to availability, validation, and order limits. We may limit quantities. Risk of loss passes on delivery to the address you provide (or upon carrier handoff where permitted by law).
Shipping, taxes & duties. Carrier options, delivery estimates, and costs are shown at checkout. Applicable taxes and duties are your responsibility unless we state otherwise.
Returns & exchanges. Return eligibility, process, and any restocking or return shipping fees are disclosed at checkout and/or in your confirmation. Certain items (for example, perishable goods, intimate apparel, custom or personalized items) may be final sale.
Warranties. Except where a supplier warranty is expressly provided to you, merchandise is provided “as-is” to the maximum extent permitted by law.
Wallet/credits. If your account includes a wallet or credits feature, accrual, adjustment (including correction of issuance errors or abuse), expiration, and redemption rules will be disclosed in your account and/or at checkout.
Prohibited uses. No purchasing for commercial redistribution or export-control circumvention unless we expressly permit it.

12. Cancellations, Changes, and Refunds

Any cancellation or modification of a booking is subject to the policies of the specific travel provider and our Cancellation Policy. You may incur cancellation or change fees based on the terms and conditions of the booking. Refunds (if applicable) will be processed in accordance with the provider's policies.

We encourage you to carefully review the cancellation, refund, and change terms before making any bookings on the Site.

13. License Grant and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and the Service for personal or internal business purposes, subject to these Terms. You agree that you will not:

Modify, reproduce, or distribute any content provided through the Site without our express written permission.
Use the Site for any unlawful or prohibited purpose.
Reverse engineer, decompile, or disassemble any software or technology used on the Site.
Interfere with or disrupt the Service, Site, servers, or networks.

Violation of any license restrictions may result in the immediate termination of your account and access to the Site and Service.

14. User Conduct and Responsibilities

You agree to use the Site and Service responsibly and in compliance with all applicable travel-related laws and regulations. You may not:

Submit or transmit any fraudulent, illegal, obscene, or harmful content through the Site.
Engage in fraudulent bookings or attempt to obtain unauthorized travel services.
Harass, abuse, or threaten other users or travel providers.
Use the Site to transmit viruses or malicious software.
Attempt to gain unauthorized access to our systems or other users' accounts.

We reserve the right to investigate any violations of these Terms and take appropriate legal action, including canceling your bookings and terminating your account.

15. Third-Party Services and Providers

Our Service includes products and services provided by third-party suppliers such as airlines, hotels, car rental agencies, and insurance providers. Snowstorm Technologies (USA) Inc. acts only as an intermediary and is not responsible for the performance, accuracy, or delivery of services provided by third parties.

You acknowledge that your interaction with these third-party providers is subject to their terms and conditions, which may include limitations of liability, cancellation policies, and specific fees.

16. Intellectual Property

All content, designs, logos, software, and technology provided through the Site and Service are owned by or licensed to Snowstorm Technologies (USA) Inc. You acknowledge that these materials are protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not:

Copy, distribute, or modify any part of the Site or Service without our written permission.
Use any of our trademarks without our prior written consent.

17. Confidentiality

You agree to keep confidential any proprietary information disclosed to you through the use of the Site and Service. This includes, but is not limited to, trade secrets, business plans, customer lists, and product information. You may not use or disclose this information without our written consent.

18. Termination

We reserve the right to suspend or terminate your access to the Site and Service at our discretion, with or without cause or notice. Grounds for termination may include, but are not limited to:

Breaching these Terms of Use.
Fraudulent or suspicious bookings.
Engaging in unlawful or harmful behavior.

Upon termination, you will lose access to your account and any data associated with it. You remain responsible for any fees or charges incurred before termination.

19. Disclaimers and Limitation of Liability

The Site and Service are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

The Site or Service will be uninterrupted, error-free, or secure.
Any defects or errors will be corrected.
The Site, Service, or its content will meet your travel needs or expectations.

Notwithstanding any damages that you might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms, and your exclusive remedy for all of the foregoing, shall be limited to the amount actually paid by you through the Service, or 100 USD if you haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, business interruption, personal injury, or loss of privacy) arising out of or in any way related to the use of, or inability to use, the Service, third-party software, and/or third-party hardware used with the Service, or otherwise in connection with any provision of these Terms, even if the Company or any supplier has been advised of the possibility of such damages, and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these jurisdictions, each party’s liability will be limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless Snowstorm Technologies (USA) Inc., its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses arising out of or related to:

Your use or misuse of the Site or Service.
Your violation of these Terms.
Any violation of law or the rights of a third party.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles. Except as provided in the arbitration paragraph below, any disputes arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the courts located in Wilmington, Delaware, USA. Disputes will be submitted to binding arbitration under the Federal Arbitration Act before the American Arbitration Association (AAA) pursuant to its Consumer Arbitration Rules. Notwithstanding the foregoing, either party may bring individual claims in small-claims court. The seat of arbitration is Wilmington, Delaware. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement. Judgment on the award may be entered in any court of competent jurisdiction. This paragraph does not prevent either party from seeking temporary or injunctive relief in court to protect rights pending arbitration.

Class Action Waiver. To the fullest extent permitted by law, disputes and claims must be brought only in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action or proceeding, in court or in arbitration.

22. Miscellaneous

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
Entire Agreement: These Terms, along with the Privacy Policy and any other agreements you enter into with us, constitute the entire agreement between you and Snowstorm Technologies (USA) Inc. regarding the use of the Site and Service.
